Eleven states within the U.S. have banned smoking in cars that contain children, and proposals are being made to pass comparable laws in West Virginia. The Centers for Disease Control and Prevention reports that adult cigarette consumption is higher in this state than any other.
The state Senate has recently passed a bill that imposes fines for smoking or having lit tobacco items in the presence of passengers under 16. The approval was granted through a vote count of 25-8, and now it is moving to the House of Delegates. Though previous efforts at similar legislation failed in the House; therefore, its future remains uncertain.
Since 2017, Senate Majority Leader Tom Takubo has been pushing for a ban on smoking in cars with minors. As a former physician who is now serving as a lawmaker, his motivation comes from making a promise to one of his patients whose father was heavily addicted to smoking. Despite the challenges he faced in gaining support for this legislation over time, it seems that the momentum toward banning this harmful behavior may finally be building up.
Takubo, a lung health specialist and Republican hailing from Kanawha County, shared an emotional account from his medical experience to justify the bill’s importance. He recounted treating a patient who had never smoked but was plagued with severe lung damage due to her father’s smoking habit. In order to escape the harmful secondhand smoke, she resorted to hiding under car seats as refuge; Takubo used this example as powerful motivation for passing the legislation.
The proposed statute would stipulate a misdemeanor charge and up to $25 in fines for offenders, while enforcing the law as a secondary offense. As such, smoking around children couldn’t be grounds alone for pulling over drivers.
Senator Mike Azinger, a Republican from Wood County, has expressed his opposition to the bill, citing it as an encroachment on parental rights by the government.
According to Azinger, the justifications for the bill are primarily based on emotions. The proposal challenges parents’ fundamental right to choose what’s best for their children in their own cars and oversteps boundaries that should not be breached by state intervention.
