Massachusetts Air National Guardsman Jack Teixeira, who previously pleaded guilty to federal offenses for leaking sensitive information online, is now set to face a military court-martial, the U.S. Air Force announced.
While the trial date for the military proceedings has yet to be determined, it will be held at Hanscom Air Force Base in Massachusetts.
Teixeira is accused of violating the Uniform Code of Military Justice, according to an Air Force statement.
The first charge states that he disobeyed an order to “cease and desist from accessing information not pertaining to his duties” on or about September 15, 2022, and again on April 13, 2023.
The second charge accuses him of disposing of an iPad, computer hard drive, and cell phone with the intent to obstruct justice in his case between March 1, 2023, and April 13, 2023. Additionally, it alleges that on or about April 7, 2023, he instructed another individual to delete Discord messages he had sent, also with the intent to obstruct justice.
Last year, Teixeira was indicted by a federal grand jury on six counts of willfully retaining and transmitting classified information related to national defense. Federal prosecutors stated that Teixeira “accessed and printed hundreds of classified documents” and posted images of them on Discord before his arrest in April 2023.
In March, Teixeira pleaded guilty to all six charges and agreed to a 16-year prison sentence. In return, prosecutors agreed not to pursue additional charges under the Espionage Act. His sentencing is scheduled for September 27.

The U.S. military retains the right to prosecute a service member separately even after a federal court conviction.

An evidentiary hearing by the Air Force was conducted in May to determine if the case should proceed to an Air Force court-martial.
