A former high-ranking FBI agent, Charles McGonigal, is set to be sentenced on Thursday after pleading guilty to a conspiracy charge. McGonigal, who led the Counterintelligence Division in the FBI’s New York field office, is at the center of a case where he is accused of clandestinely working for a sanctioned Russian oligarch, Oleg Deripaska.

Federal prosecutors are seeking a five-year prison term for McGonigal, asserting that he abused the skills and influence entrusted to him by the U.S., engaging in activities detrimental to the nation. They claim that McGonigal knowingly provided impermissible services to Deripaska, despite being aware of his sanctioned status, and sought derogatory information about a rival oligarch, Vladimir Potanin.

In their sentencing memorandum, prosecutors emphasized the severity of McGonigal’s actions, stating that he was selling something as impactful to America’s enemies as military-grade technology—an erosion in the rule of law when counterintelligence professionals operate based on financial incentives.

McGonigal’s defense argues against a prison sentence, highlighting his 22-year career in law enforcement and counterintelligence. They contend that a non-custodial sentence would be sufficient, citing McGonigal’s significant fall from grace, which resulted in the loss of his job, reputation, and family peace.

In a separate case in Washington, D.C., McGonigal faces sentencing for concealing a payment from an Albanian intelligence official while on duty. Defense attorneys acknowledge McGonigal’s impermissible services to Deripaska but argue that the information provided aligned with U.S. foreign policy by potentially sanctioning another Russian oligarch. They stress the importance of the court recognizing McGonigal’s understanding that his actions were consistent with U.S. interests despite being ethically wrong.
